The James – Application Terms & Conditions
Great! You are close to reserving your apartment. Please read the below Terms & Conditions (T&Cs) carefully and tick the box once you are happy. Electronically signing these forms means that you have read, understood, and agree to be bound by its terms.
Prerequisites

You are aged 18 or above.

You have the right to reside in the UK.

To continue your application, you acknowledge and agree that we will use your personal information, including your name, address, and contact details. We may also use this information to set up your council tax account.
Reservation Fee

Your reservation fee (payable by debit or credit card) will be the equivalent of one week's rent and will be held by The James while we process your application.

The reservation fee indicates you want to make a formal offer to rent the property you have selected.

This will be credited against your move-in monies if your application is successful.

Once the reservation fee has been paid, your referencing checks will be undertaken by our partner Homeppl.

Payment does not guarantee any reservation, nor does it bind us to let you an apartment in The James (or elsewhere) and does not commit us to or constitute an offer of a tenancy agreement.

If your application is withdrawn by The James at any time and for any reason, the reservation fee paid will be refunded in full.

Your reservation fee will not be refunded if:

You notify us that you no longer wish to proceed and withdraw your application, or you fail to take all reasonable steps to enter into the tenancy agreement (where we are taking such steps), before the deadline for agreement;

You provide false or misleading information which we are reasonably entitled to rely on in deciding whether to grant the tenancy (this includes information bearing on your suitability as a tenant). We ask that you create an account on Homeppl’s website and upload all required referencing documents promptly, and in any event in good time before the deadline for agreement; we will notify you of the outcome of your reference check on request;

You do not have, or cannot demonstrate, the right to rent in the UK under the Immigration Act 2014, such that we are prohibited from granting you a tenancy.

The deadline for entering into the tenancy agreement is 15 days after the day on which we receive your reservation fee, unless we agree a different deadline with you in writing.

Where the reservation fee is refundable, we will repay it within 7 days. Where we are entitled to retain it under one of the grounds above, we will set out our reasons in writing within 7 days of our decision not to grant the tenancy or of the deadline for agreement (as applicable). With your consent, a refundable reservation fee may instead be credited towards your tenancy deposit or first rent payment once the tenancy agreement has been signed.
Offer Accepted

On the successful completion of your referencing checks, you will be asked to pay your move-in monies and then invited to sign and complete an Assured Periodic Tenancy Agreement (APT).

Your move-in monies will comprise:

Security Deposit equivalent to five weeks’ rent (the statutory maximum where the annual rent is less than £50,000). This will be protected in a Government-approved tenancy deposit scheme within 30 days of receipt, and we will provide you with the prescribed information. Alternatively, you may choose a no-deposit option (Flatfair); we will explain how this works, and the choice between the two is yours;

Rent and utilities. Where your tenancy starts on a day other than the 1st day of a calendar month, your first payment is one full month’s rent, covering the period from your move-in date up to the day before the same date in the following month. Your second payment is then a smaller pro-rated amount, covering the period from that date up to the last day of that calendar month, and is due on the monthly anniversary of your move-in date. After that, rent is payable monthly in advance on the 1st day of each month;

Access fob deposit, which is a refundable deposit returned to you at the end of the tenancy on return of the fob in good order. Any charge to replace a lost fob will not exceed our reasonable costs, evidenced in writing.

We will advise you of your move-in date and time. In the unlikely event there is a change to this date and time, you will be notified in advance.

We will notify you of the balance due, which will have to be paid in a single payment via direct debit (we do not accept cash, cheque, giro or any other forms of payment not stated).

The payment is due 7 days prior to the start of your tenancy.

Your Tenancy Agreement will be complete and you will be a resident of The James once you have paid your move-In monies in full and have signed the AST.

In line with the Governments Right to Rent checks, you will be requested to show an original valid Passport or Driver’s Licence. We reserve the right to cancel your tenancy if you do not provide this.

You will be liable for all the charges stated in your AST.
